  1. Introductory Provisions and Definitions

1.1. These General Terms and Conditions (hereinafter referred to as the “GTC”) govern the rights and obligations of the contracting parties arising from a distance purchase contract concluded via the e-shop on the website www.beautyelevate.club.

  1. Ordering Goods and Conclusion of the Purchase Contract

2.1. The presentation of premium cosmetic products and services on the website is for informational purposes, and the Seller is not obliged to conclude a purchase contract regarding these goods (it is not a proposal to conclude a contract within the meaning of Section 43a of the Civil Code).

2.2. The Buyer places an order through the shopping cart on the platform. Before submitting the order, the Buyer has the opportunity to review and modify the entered data.

2.3. The order is considered binding the moment the Buyer clicks the button clearly marked “Order with obligation to pay” (or other equivalent text required by law).

2.4. Upon receipt of the order, the Seller will send the Buyer an automated email confirming the receipt of the order. The purchase contract is definitively concluded only upon delivery of a confirming email regarding the acceptance of the order and the dispatch of the goods by the Seller.

2.5. The Seller reserves the right to cancel the order if the product can no longer be delivered due to being out of stock, or if the Buyer provided obviously incorrect data. The Buyer will be informed of this fact without delay, and the paid amount will be refunded.

  1. Purchase Price and Payment Terms

3.1. All prices of goods listed in the e-shop are final, including all applicable taxes and fees. Prices do not include delivery charges, which are added to the order in the shopping cart process before its binding submission.

3.2. The Buyer may pay for the goods in the following ways:

  • Online by payment card (via a secure payment gateway, e.g., Stripe).

  • By any other electronic methods provided on the platform at the time of purchase.

3.3. The goods remain the property of the Seller until the purchase price is fully paid by the Buyer.

  1. Delivery Terms

4.1. Goods are standardly dispatched and delivered within the timeframes specified directly in the e-shop, but no later than 30 days from the conclusion of the purchase contract, unless otherwise agreed with the Buyer.

4.2. Delivery is provided by verified logistics partners (e.g., FedEx, courier services and similar). Delivery costs are displayed in the ordering process and are borne by the Buyer.

4.3. Upon receiving the shipment, the Buyer is obliged to visually check the integrity of the packaging. In the event of obvious damage, the Buyer is entitled to refuse the shipment from the courier and must immediately inform the Seller at secret@beautyelevate.club.

  1. Withdrawal from the Contract (Return of Goods)

5.1. The conditions for withdrawing from the contract within 14 days without stating a reason for the Consumer, including the procedure for returning goods, are detailed in the Refund and Returns Policy document, which forms an integral part of these GTC.

5.2. Hygiene exception: The Seller strongly emphasizes that, pursuant to Act No. 108/2024 Coll., the Buyer cannot withdraw from the contract and return cosmetic products that were delivered in sealed protective packaging if the Buyer has breached this packaging or opened the product.

  1. Liability for Defects (Claims)

6.1. The Seller is responsible for ensuring that the goods have the required quality upon receipt. The procedure for filing a claim, the definition of a defect, and the length of the warranty period are defined in the Refund and Returns Policy document published on the platform.

  1. Personal Data Protection (GDPR)

7.1. The processing of the Buyer’s personal data is subject to the highest security standards in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council (GDPR).

7.2. Detailed information on what data we collect, why we process it, and what the Buyer’s rights are, is provided in the Privacy Policy document, which is permanently available on the website www.beautyelevate.club.

  1. Alternative Dispute Resolution (ADR)

8.1. If the Consumer is not satisfied with the way the Seller handled their claim, or if they believe the Seller has violated their rights, they have the right to contact the Seller with a request for redress.

8.2. If the Seller responds negatively to this request or fails to respond within 30 days of its dispatch, the Consumer has the right to submit a proposal to initiate alternative dispute resolution to an ADR entity (e.g., Slovak Trade Inspection, www.soi.sk).

8.3. The Consumer may use the Online Dispute Resolution platform to submit a proposal for alternative dispute resolution, which is available at http://ec.europa.eu/consumers/odr/.

  1. Final Provisions

9.1. These GTC are valid and binding from the date of their publication on the www.beautyelevate.club platform.

9.2. The Seller reserves the right to amend these GTC. The GTC valid for the Buyer are those in effect at the time their order is submitted.

9.3. Legal relations not explicitly regulated by these GTC are governed by the relevant provisions of the applicable laws of the Slovak Republic (primarily the Civil Code and the Consumer Protection Act). This does not affect the Consumer’s rights arising from the generally binding legal regulations of the country where the Consumer has their habitual residence.
